Recent Department Work
Jim recently obtained an acquittal in the Magistrates Court for an offence of assault occasioning actual bodily harm (ABH), whereby the defendant was charged with ABH on his mother after the defendant’s mother had bit the defendant’s forearm and would not let go. Upon obtaining detailed instructions from the defendant that he had to use reasonable force in order to free his forearm from the complainant’s mouth, Jim requested from the Crown Prosecution Service the photographs of the defendant’s injury that were taken by the Police upon the defendant’s detention at the Police Station. The Crown served the photograph as part of their Unused Material Disclosure which the defence advocate at Court used as part of the defence case at trial. The Magistrates’ found the defendant not guilty of the charge of ABH.
