Commercial Disputes 

Toby regularly acts for and advises clients on commercial, partnership and shareholder disputes. The experience he has gained in handling non-contentious commercial work has allowed him to gain an even better understanding of the basis of many agreements from the very formation of the relations between the parties.

When providing Litigation advice, Toby can offer commercial guidance on preventing similar issues from arising again. Where appropriate, he always advises his clients about the benefits of settling matters quickly and outside of court. He has experience in using various forms of negotiation and mediation to achieve a successful result. 

Contractual Disputes 

Whether there is a written contract or not, Toby has assisted many clients  from individual consumers to multi-million pound investors  in various matters.

Often being involved from the earliest possible stages of a dispute, he provides clear and easytofollow advice on the best way to resolve issues.

Toby acts for both consumers and companies in contractual disputes and always ensures that a sensible, commercial approach is taken. Even so, he is mindful of the use of alternative dispute resolution methods such as mediation. 

Property Litigation 

Since law school, Property Litigation has been a part of Toby’s workload and he has acted for landlords, managing agents, portfolio owners and tenants in a wide variety of matters – ranging from right of way disputes to forfeiture and possession. He advises on both residential and commercial matters, covering everything from evictions to damages claims and ensures that his advice is always commercially minded.


Private Client 

Toby has experience in a wide range of disputes raised by private clients including Contested Probate Matters. He has acted for executors and those contesting the actions of executors in the performance of probate. Toby has also acted for third parties challenging the actions of an executor in their questionable administration of an estate and obtained a good result for the client.

He offers sensible and sensitive advice tailored to each client and seeks to provide the best possible result. The experience that he has gained by involvement in various matters ensures that Toby provides an effective service.

Professional discipline

Toby acts for professionals – such as, solicitors, architects, surveyors and others in the property and construction industries – providing clear and concise advice before and during any dispute  often considering the various risks to which a professional may be exposed. His experience in bringing and defending professional negligence claims allows him to take a considered view on a matter and prepare the most appropriate strategy for resolving the issues. 

Reported Cases

Baljit Singh Bhandal v Kieran Wallace & Eamonn Richardson (Joint Special Liquidators of Irish Bank Resolution Corporation Limited) 2017 WL 02774035 An application to set aside a statutory demand based on the mutuality between costs owed to liquidators, upon which the demand was based, and the counterclaim which was a judgment against the company in respect of which the liquidators were appointed.


Having spent several years as a court advocate, Toby is very comfortable attending hearings and advocating for his client to obtain the best possible result.
